1. Intellectual Property

All original designs, source files, and deliverables created for the Client (the “Projects”) are the exclusive property of the Client once the corresponding payment is completed.
Picked reserves the right to display pieces of the work for promotional purposes in portfolio, social media, or other channels, unless a non-disclosure agreement (NDA) has been signed.

2. Use of Third-Party Assets

If a Project includes fonts, images, or other resources requiring commercial licenses, the Client will be notified to acquire the necessary rights. The Client assumes full responsibility for the final use of such resources.

3. Service Usage Rules

The Client agrees to:

• Not use the service for illegal or fraudulent purposes.

• Not request tasks that infringe third-party copyrights or intellectual property rights.

• Work on one or more active tasks at a time, according to the subscribed plan.

• Accept that the service is offered remotely with asynchronous communication (Slack, Loom, Notion, Trello, or other agreed tools).
  
  

4. Pauses and Cancellations

The Client may pause or cancel their subscription at any time. Upon cancellation, access will be retained until the end of the paid period. No refunds are given for unused days.

5. Refunds

Refund requests will be evaluated on a case-by-case basis. If a refund is approved, Picked may retain a percentage of the amount to cover time invested.
If a refund is requested in the first month, the Client may not use the delivered materials.

6. Delivery Speed

Most designs are delivered within 1–2 business days, depending on the type and complexity of the task. The timeframe will be estimated from when all necessary information is available.

7. Tools Used

Picked primarily uses Figma, Notion, Loom, and management tools like Trello or those provided by the Client. If delivery on other platforms like Framer is desired, it must be agreed upon in advance.

8. Limited Liability

Picked is not liable for indirect damages, data loss, delays beyond its control, or misuse of deliverables by the Client. The service is provided “as is,” without guarantees of commercial outcome.

9. Content Licenses

The Client is responsible for ensuring all content provided (text, images, logos) is properly licensed. Picked will not be responsible for the misuse of material provided by the Client.

10. Jurisdiction

This agreement is governed by the laws of Portugal, without prejudice to consumer rights in their country of residence. Any conflict will be handled by the courts of Lisbon, unless otherwise agreed between the parties.
